WELCH, Presiding Judge.
Mario Dion Woodward was indicted by a Montgomery County grand jury on two counts of capital murder for his involvement in the shooting death Keith Houts, a City of Montgomery police officer. Count 1 alleged that Woodward intentionally killed Officer Houts while Houts was on duty, see § 13A-5-40(a)(5), Ala.Code 1975, and count 2 alleged that Woodward killed Houts by firing a weapon from inside a vehicle, see § 13A-5-40(a)(18), Ala.Code 1975.
