STATEMENT OF FACTS.

This is an application by appellant as a non-resident defendant under 6266 of Crawford Moses' Digest to have a decree foreclosing a mortgage on lands set aside, and to have the action retried.

It appears from the record that on November 2, 1927, John C. Gleason filed a complaint in equity against Prange Bros. Company and others to foreclose a mortgage on certain lands described in the complaint. The mortgage was executed on the 18th day of November, 1918, by C. H. Prange, George Prange and August Prange in favor of John C. Gleason to secure an indebtedness of $40,000, which…
