This was an action of assumpsit for money had and received, brought by William O. Manson against John C. McCord and Joseph T. McCord, to recover certain moneys deposited by the plaintiff with the defendants, to be used by them as margins upon a series of contracts entered -into by them on his account, for the purchase and sale of grain "on the open Board of Trade of Chicago.
