MEMORANDUM DECISION AND ORDER

HURD, United States Magistrate Judge.

I. Introduction.

This action for personal injuries was brought by plaintiff, Edward Novak (“Novak”), on November 9, 1992, upon filing of a complaint against BASF Wyandotte Corporation and BASF Corp. (“BASF”), the owners of a construction site. 1 A third-party complaint was filed by BASF on February 4, 1993, against general contractor Schenectady Steel Co. (“SSC”), seeking indemnification.
