MEMORANDUM OPINION
(November 30, 2005)
Before the Court is a Motion to Dismiss filed by Third-Party Defendant Rubber & Gasket Co. of Puerto Rico [hereinafter “R & G”]. Third-Party Plaintiff Hess Oil Virgin Islands Corporation [hereinafter “HOVIC”] opposes this Motion. Third-Party Defendants Austin Industrial, Inc. [hereinafter “Austin”] and Virgin Islands Industrial Maintenance Corporation [hereinafter “VIIMC”] joined R & G’s *272Motion.1 For the following reasons, R & G’s Motion to Dismiss shall be denied.
