I. PROCEDURAL HISTORY

The instant case is a breach of contract claim arising under the Employee Retire ment Security Act (ERISA), 29 U.S.C. § 1001, et. seq., brought by Luis Diaz Padilla against Triple-S Inc. Plaintiff seeks injunctive and equitable relief, specific performance and damages for Defendant’s refusal to cover Plaintiffs desired INTACS procedure under his ERISA-regulated insurance plan.
