RICHARD L. WILLIAMS, District Judge.

This case arises out of a knife injury inflicted on plaintiff by the defendant Compton five weeks after Compton’s release from the Shenandoah Geriatric Treatment Center of the Western State Hospital (“Shenandoah”). Plaintiff alleges that the defendant Superintendent of Shenandoah, and the defendant Wampler, a physician at Shenandoah (“the State defendants”), negligently released Compton despite their knowledge or reason to know that Compton was a dangerous person, and despite their duty to act so as not to cause injuries to the citizenry; that…
