Defendant, Elmer Danles, was convicted in a jury trial of the crime of breaking and entering the Trinity Lutheran Church of Berrien Springs, Michigan, with the intent to commit a larceny therein, under CL 1948, § 750.110 as amended by PA 1964, No 133 (Stat Ann 1968 Cum Supp § 28-.305). Elmer Danles was one of supposedly three participants in the crime.

During the course of the defendant’s trial, the prosecution called two res gestae witnesses to testify to the defendant’s presence at the scene of the crime. The witnesses, George Payne and Joe B. Ferguson, were alleged accomplices to the crime.…
