This is an action brought to recover from the defendants the sum of $125, alleged to be due the state for a license for selling intoxicating liquors for the quarter commencing October 1, 1891, and involves the constitutionality of an act entitled “An act to regulate the sale of intoxicatingliquors,” approved February 6,1891. (See Idaho 1st Sess. Laws, p. 33.)
