LATCHUM, Chief Judge.

On August 6, 1974, the Grand Jury returned a four count indictment 1 against Albert Martin (“Monk”) Shaffer, Jr. and Basil Vespe. 2 The first three counts charged Shaffer with three substantive violations of either traveling in interstate commerce, or using and causing to be used interstate telephone facilities, with intent to carry on an unlawful activity involving extortion in violation of 18 U.S.C. § 1952(a)(3).
