1Opinion of the CourtWilliams, J.

In this case the order sought to be reviewed was made on the. 18th day of April, 1907, and on the 7th day of April, 1908, a petition in error and case-made were filed in. this court. On the same day a pra3cipe for summons was filed with the clerk and summons issued thereon. On April 17, 1908, said summons was returned, showing service on Mrs. A. M. Yarnell, as administratrix, on April 16, 1908. On the 4th day of May, 1908, an alias summons was issued to A. J. Morris, attorney of record for Thomas F. Yarnell, deceased, which was returned on the 8th day of May, 1908, as having been served on…
