DECISION ON MOTION FOR PRELIMINARY INJUNCTION
McMILLEN, District Judge.
This case comes on to be heard on the Government’s Amended Motion for Preliminary Injunction and Temporary Restraining Order filed August 1, 1978. The Amended Motion has been allowed to stand with the Government’s Second Amended Complaint for Injunction subsequently filed October 2, 1978. Defendants filed an answer on October 23,1978, thereby putting both pleadings in issue.
