This cause came on to be heard upon the appeal from the Court of Common Pleas of Preble County.
On August 16, 1982, Roy P. Sims, Jr. (“Roy, Jr.”), a minor, was removed from the custody of his father, Roy P. Sims, Sr. (“appellant” or “Roy,. Sr.”), his legal custodian, by a member of the Preble County Sheriffs Department and placed temporarily with the Preble County Children’s Services Board (“Children’s Services”). On August 18, 1982, a complaint was filed by Linda Maffet, a caseworker with Children’s Services, which alleged that the child was dependent and/or neglected in violation of R.C.…
