— This is an appeal from a judgment of the Superior Court of Santa Cruz County, in favor of the defendant. The case arises out of a contested claim *237to purchase certain state lands referred to that court as the successor of the District Court, for determination, upon the application of the plaintiff under section 3414 of the Political Code. The case was tried by the court below without the intervention of a jury, and the facts fully appear from the findings, which are not excepted to, the appeal being simply from the judgment.
