OPINION

ROBERTSON, Justice.

This appeal is from a judgment non ob-stante veredicto. Appellants brought suit against Lockwood Lumber Co. and appellee Lorraine Sipe seeking money damages for wrongful foreclosure of a deed of trust. This foreclosure took place on or about November 4, 1975. The original petition was filed against Lockwood Lumber Co. on May 12, 1976. Appellee Lorraine Sipe (“Sipe”) was added as a defendant in an amended petition on September 1, 1978.
