MEMORANDUM OPINION AND ORDER
KRAM, District Judge.
On December 29, 1992, plaintiff Irving Ruderman (“Ruderman”) brought this employment discrimination action under the Age Discrimination in Employment Act, 29 U.S.C. § 626(b), as amended (the “ADEA”), seeking equitable and other relief against defendant Police Department of the City of New York (the “NYPD”). The NYPD now moves to dismiss the Complaint, pursuant to Federal Rule of Civil Procedure 12(b)(6), for failure to state a claim upon which relief can be granted. 1 For the reasons set forth below, the NYPD’s motion is granted.
