SCOTT K. FIELD, Justice.
The Texas Department of Public Safety appeals an order of expunction in favor of G.B.E. related to his arrest for driving while intoxicated. The primary legal issue presented in this appeal is whether the current version of chapter 55 of the Texas Code of Criminal Procedure allows a petitioner to obtain an expunction of records related to a charge that is dismissed, when that dismissal is obtained in exchange for the petitioner’s plea of guilty or no contest to a different charge arising out of the same arrest and for which he is ultimately convicted.
