In this action under the Contract Disputes Act, 41 U.S.C. § 601 et seq. (2006), Plaintiff Teknowledge Corporation (“Teknowledge”) challenges the Contracting Officer’s January 19, 2006 final decision disallowing costs incurred in the development of its TekPortal software program. Before the Court are the parties’ cross-motions for summary judgment pursuant to Rule 56 of the Rules of the Court of Federal Claims (“RCFC”).
