Upon relator’s appeal from an order of the district court of Washington county denying his petition for the issuance of a writ of habeas corpus, respondent moves for a dismissal of the appeal.

On December 7, 1918, relator was arraigned in district court of Aitkin county upon an information charging him with committing the crime of rape on August 27, 1918. He entered a plea of not guilty and moved that the case be continued until the following term of court.
