MEMORANDUM OPINION AND ORDER

Thomas J. Moriarty as Trustee (“Moriarty”) has sued two defendants on behalf of the Local Union No. 727 Pension Trust and the Teamsters Local Union No. 727 Health and Welfare Trust (collectively “Funds”) pursuant to the Labor Management Relations Act (29 U.S.C. § 185) and the Employee Retirement Income Security Act of 1974 (“ERISA,” 29 U.S.C. § 1132(a)(3)), seeking to recover employer contributions allegedly owed to Funds.
