On January 3, 1918, Tom Hunter filed in the county court of Choctaw county, for probate as the last will and testament of Willie Fisher the following instrument :
“September 17, 1917.
“Tom Hunter
“When I die I want you to take my body and bery Bery it by my father and mother in Spring Chapel Cemetery and after you have paid the expense of my funeral I give you all the balance of my property.
“J. E. Peltier. Willie Fisher.”
Contest was filed by Osborne Battiest et al., heirs at law of Willie Fisher. Probate on the instrument was denied by the county court and appeal was taken to the district court,…
