delivered the opinion of the court.

The accused, who are husband and wife, were (together with A. E. Martin) jointly charged with the murder of Richard O. Amos and jointly indicted. *482They were separately tried by different juries and each has been found guilty of murder in the second degree and sentenced to five years imprisonment in the penitentiary. The Commonwealth relies upon substantially the same evidence in both cases and they were argued here together.
