Memorandum: Defendant appeals from a judgment convicting him of first degree burglary, second degree assault and fourth degree criminal mischief, arising from an incident in which defendant and his brother broke into a residence and were confronted by the homeowner, whom defendant punched in the eye and knocked to the floor as the men made their escape.
