This was an action to recover money alleged to be due on a contract made and entered into by the parties hereto on or about June 24, 1907. The petition shows: That at said date Davidson had been appointed master in chancery, probate commissioner, and referee in bankruptcy of the United States Court for the Western Judicial Distinct of the Indian Territory, sitting at Muskogee, by Hon.
