Appeal from City Court of New York, Special Term. Action by Albert H. Dollard against Benjamin Koronsky and another, doing business under the firm name of B. Koronsky & Son. From an order of the City Court of the City of New York (64 Mise. Rep. 611, 118 N. Y.' Supp. 922) adjudging Max E. Bloch guilty of contempt of court, he appeals.

This is an appeal by a surety upon an undertaking, from an order adjudging him in contempt of court and fining him $2,-120, and sentencing him to 60 days’ imprisonment and committing him to prison until the fine is paid.

In the action of Dollard v. Koronsky judgment by default was entered against the defendant. The defendant then moved for an order staying proceedings by the plaintiff under said judgment pending the determination of a motion to vacate the judgment on the ground that the defendant was not served with process.
