Defendant company is engaged, in the business of building houses which it sells on contract. From this record it appears that it was an owner of at least a portion of Tannenholz Realty Company’s subdivision of Private Claim 543, located north of Michigan avenue in the city of Detroit. Upon it the company erected a large number of cottages. The location had originally been a brickyard and the clay had been taken out to the depth of several feet.
