GILL, Associate Justice.

This suit was brought by W. S. Scott against the Texas & Hew Orleans Railroad Company to recover damages for personal injuries alleged to have been suffered by him as a result of the negligence of the servants of the .company. A trial by jury resulted in a verdict and judgment for plaintiff, from which the defendant company has prosecuted this writ of error.

Plaintiff alleged that he was employed by the company as rear brakeman on one of its freight trains, and on the occasion in question, while the train on which he was at work was standing at the station of Sour Lake,…
