Appellee sued T. J. Freeman, receiver of International & Great Northern Railroad, for $20,000 damages alleged to have been suffered by him by reason of the negligence of a baggagemaster employed by said Freeman. During pend-ency of the suit, the properties of the international & Great Northern Railroad Company were sold under order of the federal court, and were bought in by Mr. Nico-flemus.
