DAYTON, District Judge.
This plea presents such an extraordinary statement of facts as to fender the legal questions involved in the motion to strike' it out extremely perplexing. It, in brief, says: The defendant company had certain established rules governing employment by it of men in the capacity of brakemen. They had to be within a certain age.
