At about 6:00 o’clock p. m. eastern standard time on March 24, 1948 Emral McGuire, his wife Kansada McGuire, and their son Leroy McGuire were traveling south on U. S. Highway No. 23 about 3 or 4 miles south of Pikeville. A truck, owned and being operated by appellee East Kentucky Beverage Company, Tom Dyer driving, was traveling north on the same highway following a truck hauling logs.
