delivered the unanimous opinion of the Court:

Plaintiff was plant manager of defendants’ large meatpacking establishment. He was employed by defendants for some years in Georgia before the latter purchased the Orangeburg Packing Company and began to operate it in the name under which they are sued. Plaintiff required and obtained a written contract of employment, prepared by his attorney, whereby he was paid a weekly salary plus “five per cent of the net profits of the business, which net profits are to be gross income less normal operating expenses * * * audited by…
