OPINION AND ORDER
HEWITT, Judge.
This case is before the court on plaintiffs Motion to Re-File Its Application for Fees and Other Expenses Under the Equal Access to Justice Act (Filing Motion).2 Defendant opposes plaintiffs Filing Motion on the ground that plaintiff had failed to timely file *719its application under the Equal Access to Justice Act (EAJA). For the following reasons, the court DENIES plaintiffs Filing Motion.
