We overrule the Motion for Rehearing filed by Appellant. We withdraw the opinion issued on May 26, 2005, and we issue the following substitute opinion in its place.
Appellees, Bruce L. Jamison and B.L. Jamison Family Limited Partnership (collectively “Jamison”), sued appellant XCO Production Company (“XCO”) for breach of a contract governing Jamison’s purchase of an interest in certain oil and gas properties.
