Appellee has filed a motion for rehearing in this case on three grounds. Ap-pellee asserts that the Court made two substantive errors in its analysis. First, Appellee asserts the Court erred by focusing its analysis of Appellee’s non-performance to the issue of breach and by not addressing the materiality of that breach. Second, Appellee asserts the Court erred by not considering evidence of latent ambiguity and in concluding that the settlement agreement was unambiguous.
