The appellant was convicted of the crime of armed robbery in the Circuit Court of Harrison County. The jury was unable to agree upon a sentence and so certified to the court, whereupon the court sentenced the defendant to serve twenty years in the state penitentiary. He appeals to this Court assigning as error the following:(1) The lower court erred in overruling appellant’s motion for a new trial on the grounds that the verdict of the jury was against the overwhelming weight of the evidence.(2) The lower court erred in failing to quash the indictment against the defendant, in that Negroes…
