Appellant was brought to trial before a general court-martial convened at Fort Jay, New York, on three charges. Charge I and the specification thereunder alleged the offense of sodomy with a male, known only by the name of “Pat,” on December 17, 1960, in violation of Article 125, Uniform Code of Military Justice, 10 USC § 925. Charge II and its specification charged the accused with the offense of soliciting a named male to commit the act of sodomy, on December 15, 1960, in violation of Article 134, Uniform Code of Military Justice, 10 USC § 934.
