This is an action brought by the appellant against the appellees for an accounting and settlement between the partners of the appellee bank. The partnership was dissolved and the bank went into liquidation on November 3, 1911. At or about the time of the dissolution the several partners appointed John McCullough as agent to assist them in the collection of the assets and payment of partnership debts.
