On August 11, 1972, Vincent V. Nardone waived indictment and pleaded nolo contendere in the Superior Court to a complaint charging him with breaking and entering a building in the nighttime in violation of G. L. 1956 (1969 Reenactment) §11-8-4. After the trial justice satisfied himself that the defendant was informed and aware of the nature of that plea and its effect as a waiver .of fundamental rights, he inquired about matters germane to sentencing.
