The Board of Supervisors of East Rock-hill Township (Board) appeals from the *918May 9, 2008 order of the Court of Common Pleas of Bucks County (trial court) that denied the Board’s appeal from a deemed approval of a conditional use application filed on behalf of Robert R. Mager. We affirm.

Mager owns property consisting of approximately 12.26 acres located within the Township’s S-Suburban Zoning District. On May 13, 2002, Mager filed an application for a conditional use permit seeking to locate a life care facility on the property. Thereafter, pursuant to Section…
