The certiorari in this case is to review the legality of an ordinance of the city council of Atlantic City awarding a contract to John H. Rothermel for the *129lighting by electricity of the city, and' also the contract for such lighting.
The ordinance was adopted by the city council and the contract awarded after advertisement for proposals, and the reception of the same from the several bidders, among which was the proposal of Rothermel, to whom the contract was awarded and in favor of whom the ordinance was adopted, he being the lowest…
