' On rehearing we withdraw the original opinion and substitute therefor the following opinion:

Suit by defendant in error, hereafter referred to as defendant, against plaintiff in error, hereafter designated plaintiff, upon a note for $1,050, alleged to have been executed by plaintiff and payable to the order of defendant, also an itemized sworn account for $1,051.10. Trial wds had before the court without a jury and judgment for defendant rendered for $1,298.30. Amended motion for new trial was overruled and notice of appeal given, and the case is before this court for review. The facts will…
