This is an appeal from a decree dismissing a petition filed by the appellant against the appellee and dissolving an injunction which had been granted as prayed for in the petition. A chattel mortgage had been given to the appellee which was executed in the name of the Buchwald Transfer Company by William J. Keyes, its President, for the sum of $1,580.00. The appellee was proceeding to foreclose the mortgage when the above mentioned petition was filed, alleging that it was given by the President without authority, and for his own benefit and not that of the company.
