The first question to be considered is whether the court erred in overruling the plaintiff’s demurrer to-Black’s intervention, and in refusing the motion to dismiss it. The-demurrer attacked the intervention on the grounds: (1) that the-court was without jurisdiction to determine the controversy as it was presented by the intervention, and could grant no relief against Anderson in Black’s behalf, since Anderson was a resident of Dawson County, and the land in question was located in that county; (2) that Black by his pleadings sought ejectment of Anderson without showing…
