Morrison, C. J.:

The defendant was prosecuted by information, filed in the Superior Court of San Joaquin County, for the crime of murder, and was found guilty of the crime of manslaughter.

It appears from the record in the case, that the crime with which the defendant was charged, was committed in the month of August, 1879; and before the new Constitution went into effect, an indictment was presented against the defendant by the Grand Jury of San Joaquin County, which indictment was dismissed by the Court, on motion of the District Attorney; and afterwards, to wit, on the 9th day of August,…
