Indicted for grasad theft (Pen. Code, § 484) and for assault by means of force likely to produce great bodily injury (Pen. Code, §245), defendant entered a plea of not guilty as to each count, waived a jury trial, waived his right to the assistance of counsel, and proceeded to trial in propria persona. He was found guilty of both charges and moved for a new trial. At the time of the hearing on the motion for new trial, defendant was represented by counsel, but the motion was denied.
