Appellant, Horticare Landscape Management, employed appellee, Jerome McDon-aid, to perform physical labor related to landscape work. His duties included stacking rocks, planting trees, building beds, and any other assigned tasks. On June 30, 1999, appellee was landscaping at a plaza on Chenal Parkway. Appellant had ten to twelve employees working on the project that day. Appellee was performing dirt work, which included operating a bobcat front end loader and loading dirt onto a dump truck.
