This action was instituted by respondent, Ray W. Banbury, plaintiff below, as special administrator of the estate of Louise W. Hazzard, deceased, by filing a complaint on the 9th day of November, 1940, in the district court of the eleventh judicial district of Idaho, in and for Twin Falls County, and in which said complaint it was sought to have two deeds cancelled, set aside and held for naught, and that it be adjudged that appellant, F.
