This matter is before us on a motion to dismiss brought by defendant on the ground that plaintiff fails to state a claim against the defendant upon which relief can be granted.

This is an action against the United States under the Federal Tort Claims Act, 28 U.S.C. § 1346(b), for injury sustained by the plaintiff on September 19, 1952, while traveling along Trompeter Gade, Queen’s Quarter, Charlotte Amalie, one of the public ways in the Municipality of St. Thomas and St. John. The injury is alleged to have occurred as a result of the failure of Donald S. Boreham, Superintendent of Public Works…
