Reversing.

We shall refer to the parties-as they were designated below, the plaintiff, H. W. Clarke, being the appellant here, and the defendant, Blue Licks Springs Company, a corporation, being the appellee here.

On May 28, 1912, the parties entered into a written contract whereby plaintiff agreed to bore on the land of defendant, in Nicholas county, a well for the purpose of obtaining Blue Lick water, petroleum, oil or natural gas.
