Alfred J. Peters, hereinafter called plaintiff, was engaged in certain litigation in the superior court of Maricopa county. Being desirous of appealing from the judgment of that court, his attorney, Joseph E. Morrison, took np with the office of the clerk of the superior court of said county the question of the amount of the appeal bond to be given. Mr. Morrison had some conversation over the telephone with 1ST. C. Moore, one of the deputies in the clerk’s office, and as a result of that conversation prepared an appeal bond in the sum of one hundred dollars, which was, in proper form, signed…
